Disqualifiers

  1. Community Supervision History:
    1. has been on court-ordered community supervision or probation for any criminal offense of the grade of Felony.
    2. has been on court-ordered community supervision or probation for a criminal offense of the grade of Class A misdemeanor.
    3. has been on court-ordered community supervision or probation for a criminal offense of the grade of Class B within the last ten years from the date of the court order.
    4. is on court-ordered community supervision or probation for any criminal offense above the grade of class C misdemeanor.
  2. Is currently charged with any criminal offense for which conviction would be a bar to licensure.
  3. Conviction History:
    1. has been convicted of a felony
    2. has been convicted of a class A misdemeanor
    3. has been convicted of a Class B misdemeanor or a Class B misdemeanor within the last ten years
    4. has a DWI/DUI conviction within the last 10 years.
    5. Has misdemeanor convictions, including deferred adjudications, above the grade of class C within the last 10 years;
  4. Has been convicted of any family violence offense of any grade;
  5. Is prohibited by state or federal law from operating a motor vehicle;
  6. Is prohibited by state or federal law from possessing firearms or ammunition;
  7. Has been discharged from any military service under less than honorable conditions.
  8. Has had a commission license denied by final order or revoked;
  9. Is currently on suspension, or has a voluntary surrender of license currently in effect;
  10. Has violated any commission rule or provision of the Texas Occupations Code, Chapter 1701;
  11. Has pending litigation-criminal or civil (including divorce).
  12. Has been convicted of two or more moving violations in the last 12 months.
  13. Admits to or has been found to have committed any Felony offense. (Except Certain Drug Offenses).

PERMANENT DISQUALIFIERS

  1. Any Conviction or Admission of any Felony except certain drug offenses.
  2. Conviction of any Class A Misdemeanor.
  3. Any Family Violence Conviction.
  4. Intentional Lying or Omissions on the application or Personal History Statement.
  5. Dishonorable Discharge from the military.

DRUG USE

  1. Engaged in the use of marijuana in the past 24 months.
  2. Engaged in the use of any other illegal drug within the past five (5) years.
  3. Engaged in the use of any drug that was prescribed for another.
    • Disqualification will depend on the prescription (narcotic used) and circumstances of use
